Commercial Licenses and Demerit Points

Drivers of Commercial Motor Vehicle should be aware that the accumlation of Demerit Points for Commercial Drivers Licence may have a more serious impact than those with passenger or private vehicle licences.

With Commercial Drivers licences the owner of the commercial motor vehicle "the company" receives a safety rating partly based upon the drivers that the company employs.

Any traffic ticket issued to a commercial motor vehicle or commercial drivers licence is reported to the Ministry of Transportation of Ontario and recording on the CVOR (Commercial Vehicle Operator Registration) of the company as well as any applicable demerit points for the offence.

Many companies will refuse to employ drivers with more than six (6) demerit points due to the high insurance premimums that these drivers will incure for the company.

A Police Officer, or Ministry of Transportation officer may demand the CVOR for the company or driver of a commercial motor vehicle. The enforcement officer may at their option record the CVOR number specifically on the traffic ticket reporting it to the Ministry of Transportation.

Even of the enforcement officer does not record the CVOR number on the traffic ticket, the Ministry of Transportation may access the information through the licence plate or permit issued for the vehicle.

As with all traffic tickets and speeding tickets drivers MUST ensure that they use all possible means to have the demerit points and CVOR points removed or reduced from the ticket. The acculation of demerit points and CVOR points can dramatically effect not only the right to drive but the insurance rates for the company.
